Can You Work While Waiting To Be Approved For Disability

I Feel The Same Way I Have

Working while waiting for your disability approval

I feel the same way. I have no money nothing. My mom has been very sick all my life. She had a disability case pending since 2003! They told her she had a 5% chance to live. I have MULTIPLE SCLEROSIS, MAJOR DEPRESSION, MAJOR ANXIETY. I lost so much weight so to not having food to eat. I was born in this country and have payed my taxes yet I have been denied food stamps, disability, Medicaid etc. I had a social worker from a supposed nonprofit clinic tell me while I was blind in one eye IM SORRY BUT THERE IS NOTHING I CAN DO TO HELP YOU. I can& #039 t work because I& #039 m sick and I won& #039 t have a chance at my third time applying for disability but if I wait on disability which seems like next to never, I& #039 ll never survive. America is one messed up place!

How Do You Improve Your Chances Of Receiving A Positive Outcome

There are no guaranteed ways for you to either speed up the time it takes Social Security to reach a decision about a claim or to receive a positive decision. But there are things you can do to improve your chances.

  • Stay with your claim: Your chances of being approved increased as you continue with the process. Remember, if you are not approved until the second or third step of the appeal process, you could receive a sizeable back pay allocation.
  • Preparation is key: Have proper medical records ready. The more up-to-date your medical records, the greater your chances of success. If you dont have the proper medical paperwork, judges need to order examinations by an independent doctor. The SSA will pay for this examination, but doctors are notoriously slow in arranging these visits. And they often dont send in their reports by the two-week deadline. This can considerably lengthen the process.
  • List all your ailments: Both medical and physical on your application.
  • Provide a clear and accurate record of your work history: It should include all aspects of the job such as effort required, if you had to lift anything, hours worked and rate of pay. All these things will be used to help determine if you qualify for SSDI or SSI benefits.
  • Hire someone to help you: Statistics from the Government Accounting Office show that when a claimant hires a lawyer to help them, they are three times more likely to have their benefits claim approved.

A Warning About Working While Waiting For Social Security Disability Benefits

I am asked questions about this a LOT. With the wait time of approximately two years from the date of filing an application to the time of a hearing on the claim, lots of people who have filed for Social Security Disability benefits ask me about working. The general rule is that for 2014 if you make $1070.00 or more per month before taxes, insurance, or anything else is taken out you are NOT eligible to even apply for Social Security Disability benefits. This amount changes each year. You can reduce the amount of your earnings by something called Impairment-Related Work Expenses . These expenses include out-of-pocket costs for items that you must take or use in order to be able to work. It can include things like medications, medical supplies or devices, including service animals, bandages, and syringes.

Another way a person may work and apply for Social Security Disability benefits is if you have returned to work for three months or less and have to stop again because of your disability. Social Security calls this an unsuccessful work attempt . Again, in most instances it has to be for three months or less, and stops because of the your disability, NOT because you arent getting enough hours dont like the job too far to drive, etc.

Canada Pension Plan Disability Benefits

The Canada Pension Plan provides monthly payments to people who contribute to the plan during their working years.

You may be eligible for CPP disability benefits if:

  • you contributed to the CPP for a certain number of years
  • you’re under 65 years old
  • you have a severe and prolonged mental or physical disability
  • your disability prevents you from working on a regular basis

The benefits include payments to children of a person with a disability.

Apply as early as possible if you think you’re eligible for CPP disability benefits. Quebec residents may be eligible for a similar program called the Quebec Pension Plan . It may take several months to process your application.

If you applied for CPP or QPP disability benefits and were told that you’re not eligible, you can ask to have your application reviewed or considered again.

Once you reach age 65, your CPP disability benefit will automatically change to regular CPP payments. Your regular CPP payments may be less than the CPP disability payments you got before.

Common Places For Financial Help

Can You Work While Receiving Social Security Disability ...

Places you might consider contacting for financial help while you are waiting for your Social Security Disability to be approved include:

  • Family. In many cases, family should be the first place you look for financial assistance. While no one wants to be a burden to his/her family, it can be somewhat humbling to ask for help and your family is often your best bet for financial assistance while you are seeking Social Security Disability benefits.
  • Friends. Sometimes a nearby friend is better than a far away relative. You may be surprised how many friends are willing to help, especially if they are aware of the circumstances surrounding your pending disability claim.
  • Church or other Religious Organization. If you have a regular place of worship, make them aware of your need. If you dont worship anywhere, you may consider contacting religious organizations, as many of them are actively involved in charitable outreach to their communities. The Salvation Army, in particular, is a good place to turn for help with food, basic necessities, and utility bills.

Survival Assistance While Waiting For Disability Approval

How do you survive while waiting for a disability approval letter from Social Security? The application and review process can drag on for months or years.

Potential recipients have three places to turn for financial assistance.

Finding help paying bills is most realistic because welfare programs target low-income households where you might fall while unable to work.

Replacing income through other government benefits is hit or miss because many people do not have short-term coverage although a minority do.

Taking out a loan is rarely a good idea because denials and delays are more common than approvals although payment deferrals might work better.

Who Qualifies For Social Security Disability Or Ssi Benefits

If youre still earning more than $1180 a month, the Social Security Administration will not consider you disabled.

To be considered disabled, you must:

  • Have a medical condition with a terminal diagnosis or will last at least one year, preventing you from working short-term or partial disabilities do not qualify. There is a list of adult impairments that fall under Social Security, and you check and see if your condition qualifies.
  • Fall under the Social Security Administrations definition of disability.
  • Be younger than the age at which you qualify for retirement benefits from the Social Security Administration.

Places To Go For Financial Resources

Many individuals who file for Social Security Disability benefits find that they need the help of family, friends, or charitable organizations while they are waiting for their claim to be approved.

Should your claim be approved, you will, of course, receive back pay and should have little trouble paying back those who have helped you.

If you are in need of financial assistance, one of the first places you should go is your county Department of Social Services. While the kinds and amounts of assistance available vary from one locale to the next, the Department of Social Services is often the best place to look.

They have information on government programs for which you may qualify and the often have information regarding private or not for profit programs you can seek help from while you are waiting for your Social Security Disability benefits.

How Much You Will Receive

The amount of your monthly SSDI benefit is based on your lifetime average earnings covered by Social Security.

If you don’t already have an estimate, you can get your Social Security Statement online with your personal mySocial Security account or use our Benefit Calculators to determine how much you could get if you became disabled right now.

How Can You Speed Up The Social Security Disability Process

Several ways exist to qualify for a faster decision:

  • TERI: If the applicant has a terminal disease or condition. You dont need to report that you have a terminal disease, although you can. The SSA can determine this from your medical reports. A field officer can identify a condition as terminal during an interview or the condition can be brought to the attention of the SSA by anyone helping you with your claim.
  • Quick Disability Determination : Allows you to file your initial claim electronically. The SSA uses a predictive model that helps it analyze this claim to see if it warrants fast-tracking. You must be suffering from a serious condition and have medical evidence to prove it. If a claim meets the requirements, it will receive a faster decision.
  • Compassionate Allowances : Helps Social Security evaluate claims more quickly based on certain conditions. The SSA receives information from the public and a variety of different groups to determine what conditions qualify for a CAL. If your application meets the requirements, it will receive a faster decision.

Can You Collect Unemployment While Waiting For Disability To Be Approved

  • Posted on Feb 14, 2011

As far as SSI or SSDI claims, collecting unemployment does not automatically disqualify you from collecting Social Security Disability. However, if you go to a hearing, the judge may use the fact that you stated to unemployment that you are ready, willing, and able to work as a factor to deny your claim. Of course any money you collect from unemployment could reduce, or depending upon the amount, eliminate your disability benefits for the months you get unemployment. The Chief ALJ for Social Security has sent a memorandum to all ALJs reminding them that you can not be denied solely because you collected unemployment benefits. However, collecting benefits may be used to deny benefits if it is supported by other evidence that you are not disabled. While it may take some time to be approved for benefits. File right away. The longer you are out of work the greater chance you will not have enough credits to qualify for SSDI. In addition, you could be entitled to back benefits depending upon when determine you were disabled. Actual legal advice can only be provided by an attorney licensed in your jurisdiction, with experience in the area of law regarding your question.

Can You Work While Applying For Disability Benefits

Its a conundrum: youre applying for disability benefits because you can no longer work But while youre waiting and trying to qualify, the bills keep coming. You need income and have to work, even though youre in pain and barely or unable to work. So whats the solution?

The short answer is: Yes. You can apply for disability while youre still working, but there is a limit to how much you can earn. As long as you earn less than $1,310, the 2021 threshold for monthly income, you are able to continue working. For applicants who are legally blind, the limit is $2,190.

However, its not quite as simple as that.

So Sorry To Hear About Your

So sorry to hear about your situation Cathy. You& #039 ve been given some good advice, but some of it isn& #039 t 100% accurate. I was in an accident back in 2013 that left me with lower back issues, so I& #039 m VERY familiar with the whole process. Firstly, at this point the deadline for filing a personal injury suit has definitely passed, so unfortunately in that regard to my knowledge there& #039 s nothing you can do, but I recommend calling some personal injury attorneys just to be sure. Secondly, as far as insurance is concerned, your insurance would give you a difficult time in covering anything since you were in a freind& #039 s car at the time. Your friend& #039 s insurance is who you should get in contact with, as insurance coverages have amounts for passenger coverage. Had you been in your vehicle, that would be entirely different, it would have been a no-fault claim provided that evidence indicated that the person who hit would was entirely at fault. However, no-fault works on a state by state basis so if that were the case, your insurance company may not even provide no fault coverage.

Can I Collect Retirement Benefits While Waiting For A Disability Decision

What to do while waiting for Disability

Hi Larry, I’m age 62. Can I collect Social Security benefits while I wait for a determination on my SS Disability claim ? I understand this process takes some time as they collect medical verification. Will this early withdrawal adversely affect my disability benefit if I am approved ? Secondly, is it worthwhile to hire a disability advocate to move things along quicker ?

Thank you

Yes, it’s possible to draw reduced retirement benefits while your disability claim is pending. However, your benefit rate will be permanently reduced if you are paid for any months prior to your month of disability entitlement.

For example, say Bill has a full retirement age rate of $2000 and he files for both reduced retirement benefits and disability benefits at age 62. Bill starts out getting his reduced retirement rate of $1500 while his disability claim is pending. Eventually, Bill’s disability claim is approved with an onset date of age 62, but since there is a 5 month waiting period for disability benefits Bill isn’t eligible for disability benefits until he is age 62 & 5 months. Since Bill drew 5 months of reduced retirement benefits prior to his first month of disability entitlement, Bill’s disability benefit rate would be $1944 instead of $2000. In other words, Bill would keep a roughly 2.8% reduction for drawing 5 months of reduced retirement benefits prior to converting to disability benefits.

Best, Jerry

Working While You Wait

Having part-time employment is by no means a barrier to receiving disability payments from the federal government. What matters here is the level of income youre able to earn and the type of work youre able to do. After an examiner approves your application, theyll examine your financial records to see what type of income youve earned since you became disabled. If your income is more than $1,040 per month, theyll consider you able to perform a substantial gainful activity and deny your application.
