I feel the same way. I have no money nothing. My mom has been very sick all my life. She had a disability case pending since 2003! They told her she had a 5% chance to live. I can& #039 t work because I& #039 m sick and I won& #039 t have a chance at my third time applying for disability but if I wait on disability which seems like next to never, I& #039 ll never survive. America is one messed up place!

How Do You Improve Your Chances Of Receiving A Positive Outcome

There are no guaranteed ways for you to either speed up the time it takes Social Security to reach a decision about a claim or to receive a positive decision. But there are things you can do to improve your chances.

  • Stay with your claim: Your chances of being approved increased as you continue with the process. Remember, if you are not approved until the second or third step of the appeal process, you could receive a sizeable back pay allocation.
  • Preparation is key: Have proper medical records ready. The more up-to-date your medical records, the greater your chances of success. If you dont have the proper medical paperwork, judges need to order examinations by an independent doctor. The SSA will pay for this examination, but doctors are notoriously slow in arranging these visits. And they often dont send in their reports by the two-week deadline. This can considerably lengthen the process.
  • List all your ailments: Both medical and physical on your application.
  • Provide a clear and accurate record of your work history: It should include all aspects of the job such as effort required, if you had to lift anything, hours worked and rate of pay. All these things will be used to help determine if you qualify for SSDI or SSI benefits.
  • Hire someone to help you: Statistics from the Government Accounting Office show that when a claimant hires a lawyer to help them, they are three times more likely to have their benefits claim approved.

A Warning About Working While Waiting For Social Security Disability Benefits

I am asked questions about this a LOT. With the wait time of approximately two years from the date of filing an application to the time of a hearing on the claim, lots of people who have filed for Social Security Disability benefits ask me about working. The general rule is that for 2014 if you make $1070.00 or more per month before taxes, insurance, or anything else is taken out you are NOT eligible to even apply for Social Security Disability benefits. This amount changes each year. You can reduce the amount of your earnings by something called Impairment-Related Work Expenses . These expenses include out-of-pocket costs for items that you must take or use in order to be able to work. It can include things like medications, medical supplies or devices, including service animals, bandages, and syringes.

Another way a person may work and apply for Social Security Disability benefits is if you have returned to work for three months or less and have to stop again because of your disability. Social Security calls this an unsuccessful work attempt . Again, in most instances it has to be for three months or less, and stops because of the your disability, NOT because you arent getting enough hours dont like the job too far to drive, etc.

Canada Pension Plan Disability Benefits

The Canada Pension Plan provides monthly payments to people who contribute to the plan during their working years.

You may be eligible for CPP disability benefits if:

  • you contributed to the CPP for a certain number of years
  • you’re under 65 years old
  • you have a severe and prolonged mental or physical disability
  • your disability prevents you from working on a regular basis

The benefits include payments to children of a person with a disability.

Apply as early as possible if you think you’re eligible for CPP disability benefits. Quebec residents may be eligible for a similar program called the Quebec Pension Plan . It may take several months to process your application.

If you applied for CPP or QPP disability benefits and were told that you’re not eligible, you can ask to have your application reviewed or considered again.

Once you reach age 65, your CPP disability benefit will automatically change to regular CPP payments. Your regular CPP payments may be less than the CPP disability payments you got before.

Of course any money you collect from unemployment could reduce, or depending upon the amount, eliminate your disability benefits for the months you get unemployment. The Chief ALJ for Social Security has sent a memorandum to all ALJs reminding them that you can not be denied solely because you collected unemployment benefits. Yes, it’s possible to draw reduced retirement benefits while your disability claim is pending. However, your benefit rate will be permanently reduced if you are paid for any months prior to your month of disability entitlement.

For example, say Bill has a full retirement age rate of $2000 and he files for both reduced retirement benefits and disability benefits at age 62. Bill starts out getting his reduced retirement rate of $1500 while his disability claim is pending. Eventually, Bill’s disability claim is approved with an onset date of age 62, but since there is a 5 month waiting period for disability benefits Bill isn’t eligible for disability benefits until he is age 62 & 5 months. Since Bill drew 5 months of reduced retirement benefits prior to his first month of disability entitlement, Bill’s disability benefit rate would be $1944 instead of $2000. In other words, Bill would keep a roughly 2.8% reduction for drawing 5 months of reduced retirement benefits prior to converting to disability benefits.
