What Medical Conditions Qualify For Cpp Disability

Any medical condition can qualify for CPP disability if it prevents you from doing gainful employment. You must also prove that your disability is permanent.

Following is the offical requirement for CPP disability benefits. Your medical condition must cause a level of disaiblity to meet the following requirement:

Section 42. When a person is deemed disabled For the purposes of this Act,

a person shall be considered to be disabled only if he is determined in the prescribed manner to have a severe and prlonged mental or physical disability, and for the purposes of this paragraph,

a disability is severe only if by reason thereof the person in respect of whom the determination is made is incapable of regularly pursing any substantially gainful employment, and

a disability is prolonged only if it is determined in the prescribed manner that the disability is likely to be long continued and of indefinite duration or is likely to result in death

In common terms, you can only qualify for CPP disability if your medical condition causes permanent disablity that prevents you from regularly doing any employment.

Moderateva Disability Rating: 10%

If during your examination the VA doctor finds certain qualifying criteria, you may be assigned a VA disability rating of 10%. The qualifying criteria are as follows:

• Your weight-bearing line is over your big toe
• You experience pain upon manipulation or when using the foot
• You have inbound bowing of the Achilles tendon

Secondary Service Connection For Foot Conditions

Secondary service connection represents another avenue of service connection for foot conditions. A secondary service-connected disability is one that is either aggravated or caused by an already service-connected condition. For example, you have a service-connected knee condition that causes you to alter your gait. This then results in a foot condition because you are putting extra pressure on one of your feet. Here, your service-connected knee condition caused your foot condition. Therefore, secondary service connection is warranted. Importantly, you must provide a medical nexus in support of the causal relationship between your knee and foot conditions.

Similarly, if you have a service-connected foot condition that causes or aggravates another condition, then that disability can be service-connected as well.

Service Connection By Aggravation

Veterans who entered military service with pre-existing heel pain or foot injuries may be able to claim service connection by aggravation if their plantar fasciitis worsened. Medical records for aggravated or secondary conditions must prove that the new injury is not temporary. A doctor must also submit in writing that any secondary conditions, including plantar fasciitis, worsened strictly due to military service and not natural disease progression.

My dr told me I should take a month off from work to ensure minimum swolling during the duration of my foot healing. Would I be eligible for disability?

I mean, one month’s pay? You would need to use up your sick time and vacation pay from your work. Musculoskeletal System And Connective Tissue

The SSA reports that the largest category of diagnoses among disabled workers receiving disability benefits was diseases of the musculoskeletal system and connective tissue. These disabilities, which represented 32.3 percent of the diagnoses, involve damage to ones nerves, muscles, tendons or ligaments. Examples of this type of disorder include:

• ArthritisAn individual with rheumatoid arthritis, a disorder of the immune system, must experience significant limits on his or her ability to work to qualify for benefits under this medical diagnosis. Rheumatoid arthritis is sometimes referred to as a connective tissue disorder.

• FibromyalgiaFibromyalgia is a complex syndrome in which a person has widespread pain in the joints, tendons, muscles and soft tissues that lasts for more than three months. Why Do Foot And Ankle Injuries Occur

Ankle sprains are also called soft-tissue injuries. They can be caused by single, direct impacts, exposure to thermal factors and/or chemicals or repetitive micro-trauma.

Sprains occur when ligaments connecting the bones suddenly stretch or tear, as in a twisted ankle. If not treated properly, sprains can lead to weak ankle joints. Feet or ankles can also be fractured due to a sudden, awkward turn of the foot or collision with a heavy or dense object.

Sports accidents account for many of these types of injuries. For instance, they may occur while playing basketball, football, running or even dancing. You can also injure a foot or ankle by simply tripping or twisting it while walking.

Other causes for ankle and foot pain are infections of the ankle joint, osteoarthritis, gout, rheumatoid arthritis and Reiter syndrome, nerve injuries, injuries to the heal or blocked blood vessels in the leg.

Plantar fasciitis, for example, is a condition where the tissue on the bottom of the foot that connects the toes to the heel becomes inflamed. This condition can make walking, running and standing highly painful.

Social Security Will Consider Your Reports Of Pain As Long As There Is Some Evidence Of A Physical Or Mental Impairment

Chronic pain is ongoing or recurrent pain that continues longer than the usual course of acute illness or injury, or more than three to six months. Chronic pain may manifest in any area, including back pain, headaches, joint pain, or generalized muscle or nerve pain. It may be related to an injury or illness, or it may have no known cause. You may get diagnosed with a pain disorder such as chronic regional pain syndrome, somatoform pain disorder, or reflex sympathetic dystrophy , or a disorder that causes chronic pain, such as peripheral neuropathy, tendinitis, carpal tunnel syndrome, fibromyalgia, arthritis, or ilioinguinal neuralgia.

Severeva Disability Rating: 20

The VA deems pes planus to be severe when there is clear evidence of a deformity in the foot. Along with this, the qualifying criteria are:

• Pain when the foot is used or manipulated
• Swelling occurring after use of the foot or feet
• Presence of characteristic callosities

The exact rating that you receive in this category will depend on whether your condition is unilateral or bilateral. If you have unilateral pes planus , you can receive a VA disability rating for foot pain of 20%. If it is bilateral then your disability rating may be 30%.

How Do I Apply

You can do it through the local Social Security Administration office or state agencies .

You can apply in person, over the phone, by mail, or online. DDS will get information from your doctors to decide if your diabetes qualifies as a disability.

If you donât qualify, your case is kept on file in case you decide to appeal.

The process isnât quick. It can take 3 to 5 months to get a decision, depending on how long it takes for DDS to get your medical records and other information they need.

Itâs not unusual to be turned down the first time you apply. Up to 80% of first-time applications are rejected. If you appeal, it can take another 3 to 5 months to get a decision. If that appeal gets denied, you can appeal once more before an administrative law judge. That process can take as long as 2 years.

Can You Do Any Other Type Of Work

If we decide you cannot do the work you did before, we consider your remaining ability to do other work considering your age, education and work experience. We assess these factors with your capacityto work to determine if you can be expected to adjust to other work that existsin the national economy.

We consider how many years of school you have completed and whether you have completed any type of special job training, trade or vocational school when we assess your ability to adjust to other work. However, absence of formal education does not necessarily mean you are uneducated or limited in your ability to adjust to work. We will consider strong evidence that your educational achievement is higher or lower than the last grade you completed.

We generally consider illiteracy and inability to communicate in English as an educational factor that limits an individuals ability to adjust to other work.

We consider your chronological age in combination with your residual functional capacity, education, and work experience. We will not consider your ability to adjust to other work on the basis of your age alone. In determining the extent to which age affects your ability to adjust to other work, we consider advancing age to be an increasingly limiting factor in your ability to make an adjustment to other work.

What Medical Conditions Qualify For Long

Most medical conditions can qualify for long-term disability. However, some long-term disability plans will exclude certain medical conditions.

Assuming you dont have an excluded condition, then you can qualify for long-term disability benefits if your medical conditions prevents you from doing your regular work. You wont qualify to apply right away. Most long-term disability plans require you to be continuously disabled for a number of weeks before you are eligible to apply. This called the waiting period or elimination period.

The most common length of the waiting period is 17 weeks, but this can be different for each disability plan.

Most long-term disability plans have a two tier requirement for disability. For the first 2 years you can qualify for benefits if your medical condition prevents you from doing your regular work.

However, after 2 years, you can only qualify for long-term disability benefits if your medical conditions prevents you from doing any gainful work .

Following is an example of a long-term disability requirement fround in a group long-term disablity plan. This is only an example and these requirements and wording vary from plan to plan.

An employee is entitled to payment of a long term disability benefit if the employee presents proof of claim acceptable that:

• the employee became disabled while covered
• total disability has continued beyond the elimination period
• the employee has been folloing appropriate treatment for the disability condition

Va Disability Ratings For Plantar Fasciitis

The Department of Veterans Affairs changed its schedule of ratings for plantar fasciitis effective February 7, 2021. The maximum disability rating is 40 percent, and the schedule of ratings is as follows:

• 30 percent rating when the veteran has received no relief from surgical or non-surgical treatment methods, such as wearing orthopedic shoes, inserts, or arch supports. This percent rating only applies when plantar fasciitis affects both feet.
• A 20 percent rating applies when the veteran meets the above requirements, but the plantar fasciitis only impacts one foot.
• A 10 percent rating applies for cases of plantar fasciitis classified as otherwise. This percent rating can apply to one or both feet.

The VA also applies two special disability ratings for plantar fasciitis. Veterans who have plantar fasciitis and experienced the actual loss of use of the foot qualify for a 40 percent disability rating. A special disability rating of 20 or 30 percent applies to veterans who received a surgical recommendation from their doctor but are not a candidate for surgery. Whether a veteran receives a 20 or 30 percent disability rating depends on if the plantar fasciitis is unilateral, affecting only one foot, or bilateral, affecting both feet.
