Why Does Your 100% P& t Disability Rating Matter When Applying For Ssd Benefits

Firstly, it lets the SSA know that youre a disabled veteran who already qualifies for VA disability benefits. This means the agency can easily pull your medical records and treatment history electronically, which theyll initiate as soon as you file. Second, you should identify yourself as such when filling out your application or talking to someone on the phone. However, if youre still working or receive military pay when you apply, you likely wont get approved for SSD benefits.

Can 100 Disabled Veterans Work If Tdiu P& t The Exception

Of course, the VA does have an exception to the working rule. Can 100 disabled veterans work if TDIU? Not really. TDIU is the exception. Total Disability Individual Unemployability is a form of 100% disability through the VA. Veterans who cant maintain employment because of their service-connected injuries may be eligible for TDIU. The VA pays TDIU claims at the same level as those given to veterans with a 100 percent disability. However, the veteran does not have to be rated at 100%.

Veterans receiving TDIU can only earn up to $13,590 annually. Making more than the limit can result in the VA rescinding your TDIU. As a result, I would hesitate to work if I was receiving TDIU. Especially if that TDIU is P& T.

The Tdiu Workaround: A Protected Work Environment

If you earn less than the federal poverty threshold, but your job isnt meeting your needs to support your family, you need to know about what the VA considers a protected work environment.

If your employer assists you due to your disability, allowing you to continue working while making more than the poverty threshold, the VA will consider this employment in a protected work environment.

You could continue working at an income level if your job meets one of these criteria of a protected work environment. These are merely examples, as the VA has no set criteria:

  • Being paid the same for less work productivity as other employees
  • Being excused from mandatory training

The VA Regional Office will likely determine if the accommodations your employer provides for you meet the criteria of a protected work environment. You can find the guidelines from the Department of Labor for your specific job to find the duties generally required. You can then use these to support your claim and show the accommodations that help you accomplish your job functions.

Family businesses are one of the most common places veterans are approved for protected work environments.

How Veterans Can Legally Work With A 100% Disability Rating

There is an important distinction between the schedule of ratings and the Individual Unemployability rating.

If a veteran has received a 100% schedule of ratings, then they may still be eligible to work and receive benefits. However, veterans who are classified at an 100% unemployability veteran are not permitted to have substantial gainful employment.

While this is listed in the Code of Federal Regulations, there is no comprehensive list that clearly describes the meaning of substantial gainful employment.

Instead, the Code of Federal Regulations defines what it does not consider to be a violation of these rules something called . This is defined as follows:

marginal employment generally shall be deemed to exist when a veterans earned annual income does not exceed the amount established by the U.S. Department of Commerce, Bureau of the Census, as the poverty threshold for one person.

This marginal employment may also include, according to the code, employment in a protected environment such as a family business or sheltered workshop when earned annual income exceeds the poverty threshold.

While this may be a confusing topic, the main points to remember include:

Types Of Protected Va Ratings Not Subject To A Routine Future Evaluation

  • The disability is Static, without material improvement for 5 years or more.
  • The disability is Permanent in character and of such nature that there is no likelihood of improvement.
  • The disability has been in place for 10 years or more. *Note: The rating can still be reduced if medical evidence shows that the disability has improved.
  • The disability has been continuously in effect for 20 years or more.
  • The veteran is over 55 years of age .
  • The veteran has a 100% VA rating thats deemed a total disability. *Note: The VA can only reduce the rating if the medical evidence demonstrates material improvement.
  • The disability is rated at the prescribed schedular minimum within its Diagnostic Code
  • The disability is rated at 10% or less, OR
  • The combined evaluation would not change even if the VA reevaluation resulted in a reduced evaluation for one or more disabilities.

Can Veterans Work While Receiving Tdiu

There are certain situations in which VA can still consider and grant TDIU when a veteran is working. Again, the regulation requires that you are unable to secure and follow substantially gainful employment. VA considers jobs that result in annual income less than that of the federal poverty threshold to be marginal employment. Importantly, veterans who are only engaging in marginal employment are still eligible for TDIU.

There are additional circumstances where veterans who earn above the federal poverty threshold may still receive TDIU benefits. Here, veterans must be receiving extensive and unreasonable accommodations from their employer, resulting in a protective work environment. If the accommodations are afforded due to the veterans service-connected conditions, and without such accommodations the veteran would not be employed, TDIU should be considered.

How To Work With A 100% Schedular Disability Rating

If youre given a 100% VA rating, this is also called a total VA rating. This means youre disabled at the highest level for your disability. In order to be granted this rating, you must have at least one service-connected disability however, you could have more.

Can you work with 100% VA disability if you have a schedular rating? Yes! There are no work restrictions on a 100% schedular VA rating. Many veterans with one condition rated at 100% are severely impacted to the point where employment becomes difficult. Disability ratings and pay are scaled by percentages. One veteran may be listed as 10% disabled, while another one is rated at 100%, depending on the conditions and circumstances. But high percentages do not necessarily mean a veterans disability percentage impacts their ability to work or perform self-care.

The VA may assign a percentage to a single condition, or a disability rating might be made up of smaller percentages assigned to multiple conditions.

If one type of injury results in a 60% disability rating, and another injury results in a 25% rating, the VA would recognize the veterans total percentage of disability at 70% .

Thats because the second disability rating is calculated by how much it affects the veterans non-disability percentage. To the VA, a veteran with a 60% disability has a 40% ability percentage. The combined percentage rating is calculated by the effect the new 25% disability rating has on the 40% ability percentage. One-fourth of 40% is 10%. So the veterans combined disability score is 70% instead of 95%.

Receiving A Temporary Veterans Disability 100% Rating

VA disability ratings arent necessarily permanent. The VA awards a temporary 100% rating when a veteran has a condition that is expected to improve in the future. For example:

  • A veteran can receive a temporary 100% rating when discharged from service with an injury that makes immediate employment not advisable.
  • A veteran can receive a temporary 100% rating when they are hospitalized for 21 or more days for a service-connected condition.
  • A veteran can receive a 100% rating if they are having surgery for a service-connected condition and will require an extensive recovery time that limits their mobility.

There are two ways in which you can receive a schedular 100 percent disability rating:

  • You have a 100 percent rating based on one disability alone OR
  • You receive a combined disability rating of 100 percent, meaning the combination of all of your disability ratings for each service-connected condition is 100 percent.
  • However, it is important to note that disability ratings are not added together in the traditional way. Instead, VA uses its own form of math when combining disability ratings. To avoid doing VA math by hand, use the VA math calculator found on our website.

    Importantly, VA does round up. Therefore, if the VA math calculator produces an outcome of 75 percent, it means you are likely entitled to an 80 percent combined disability rating. Ultimately, certain conditions might be considered permanent regardless of whether or not the veteran is working. However, veterans should be mindful of the fact that the idea of a P& T disability rating presumes that the condition is totally incapacitating.
