The first stage of appeals involves filing a VA FORM 21-0958, Notice of Disagreement , with the VA. What Is The Board Of Veterans Appeals

The Board of Veterans Appeals is an entity that conducts hearings and decides claims for veterans benefits once they have been appealed from the agency of original jurisdiction, usually a VA Regional Office. The Board issues Veterans claims a docket number before it partakes in what is called a de novo review, meaning a fresh look at the veterans case. Adjudicators at the Board subsequently make a decision based on the evidence of record.

Veterans Can Now Appeal A Va Claim Online

This is generally the last step in the VA appeal process. At this stage, you will want to contact an attorney to help you fight for your rights. The U.S. Court of Appeals for Veterans Claims is a Federal Court, and appealing a claim to this level involves complex rules and procedural details.

Moving through these stages of appeals can take a very long time typically a few years after receiving your Decision Letter from the VA. As a general matter, the Board is required by law to review appeals in docket order. However, the Board may advance an appeal on the docket if the appellant demonstrates unusual hardship such as serious illness, severe financial hardship, or other sufficient cause. 38 U.S.C. § 7107, 38 C.F.R.§§ 20.800, 20.902. If you would like to request prioritization of your appeal, submit your request in writing to the Board stating the basis for your request, and include supporting documentation to factually demonstrate reasons for advancement. The following are some examples of unusual hardship or other potential sufficient cause, along with recommended supporting documentation :

  • Severe financial hardship
  • Serious illness
  • Administrative error resulting in a significant delay in docketing your appeal and
  • Unusual hardship due to a natural disaster such as a hurricane, earthquake, or flood

What To Expect At A Va Board Of Appeals Hearing

If you choose to appeal directly to the VA Board of Appeals and request a hearing, you can expect a hearing with a Veterans Law Judge. Hearing usually takes about 30 minutes.

The hearing is an opportunity for you to tell your story to the judge. You should tell the judge why you think the original VA decision should be overturned. Youll submit new evidence and answer any questions the judge has about your appeal.

The judge may ask you questions, but it will not be like a cross-examination. Answer the questions forthrightly and be ready to present any new evidence you brought with you. This is the time when your representative, if you choose to have one, may help you.

The judge may offer advice on what you can do to help qualify for VA benefits. This may include additional VA medical exams or tests.

Dont expect a decision at the end of your hearing. Instead, your case will be added to the boards list of appeals to work on in the future.

A hearing docket appeal typically takes the longest of all the VA Board of Appeal options. Weve seen drastic changes in the amount of time a hearing takes to get scheduled based on the boards caseload. In 2022, a hearing with the VA Board of Appeals takes about 18 months to receive a decision after filing your appeal.

Who Makes Up The Board Of Veterans Appeals

The Board of Veterans Appeals has a Chairman, a Vice-Chairman, and a group of Veterans Law Judges who are also known as Members of the Board. The Board specifies no set number of judges. The count of judges can vary based on appeals volume at any given time.

The Boards judges have a large administrative staff that consists of attorneys and other personnel. Staff members assist the judges with paperwork and reviewing claims. The Chairman presents a report at the end of each fiscal year that summarizes Board activity and projects appeals volume and staff needs for the upcoming fiscal year.

New Process At The Board Under Ama

Under AMA, veterans have one year to appeal an unfavorable decision from VA by choosing one of the following three review options, or lanes: the higher-level review lane, supplemental claim lane, and Notice of Disagreement lane . In the Notice of Disagreement lane, veterans can appeal their claims directly to the Board.

Previously under the Legacy appeals system , veterans who received unfavorable decisions were required to overcome additional procedural hurdles when appealing to the Board, including the filing of an additional form and subsequent VA processing. However, the Notice of Disagreement lane under AMA removes the additional steps. By directly appealing to the Board, VA is hoping to prevent a backlog of claims and significantly decrease veterans amount of wait time when it comes to receiving decisions.

Importantly, veterans also have the option to choose the Notice of Disagreement lane after receiving unfavorable decisions in either the higher-level review lane or supplemental claim lane. Here, the one-year period to appeal remains the same. If veterans successfully appeal within that timeframe, they will preserve the effective date of their claim.

What Decisions Can Come From A Board Of Veterans Appeals

You can get several different types of decisions from the BVA: granted, remand, or denied. You could also get several decisions based on how many issues youre appealing.

  • Granted Your appeal has been successful. The board can assign you a rating decision and effective date that your regional office must honor. However, sometimes the board merely overturns the decision, and your regional office will issue a rating percentage and effective date.
  • Remand Your case has been sent back to the regional VA for further review with additional instructions to better explain your claim . Remands are usually required if the law changes, if the condition on appeal worsens, or if the veteran presents new evidence to the board.
  • Denied The BVA has decided not to overturn the VAs original decision on your claim.

Will The Judge Make A Decision On My Appeal At The Hearing

No. The Board reviews cases in the order theyre received. The judge will begin work on your appeal when its among the oldest appeals ready for their review.

The Board will create a transcript of your hearing and add this to your appeal file. The Board will ask if youd like a copy of the transcript for your personal records. The judge will review the hearing transcript along with all the other evidence in your file when they make a decision on your appeal.

Board Has Made Slow But Steady Progress In Reducing Its Workload After Congress Incapacitated It For Five Years

In 2014, an independent federal agency in charge of researching and enforcing civil service laws across government decided it wanted to know more about federal employees experiences with sexual harassment in the workplace.

In 2016, that agencythe Merit Systems Protection Boardsent a detailed survey to 114,000 employees across two-dozen agencies to solicit the information.

The response rate was impressive. MSPB received completed surveys from more than 42,000 employees, offering the first such insights into sexual harassment at federal agencies in more than 20 years. The agency took a little more than a year to review the responses and compile a report. By early 2018, it was ready for release.

There was only one problem: the agency was statutorily prohibited from releasing it.

Due to congressional inaction, MSPB had lost the quorum on its central board. It could no longer issue decisions that agencies or employees appealed to that level, nor could it issue its research. The agency put out a brief summary of its findings, but it included few details.

The board has decided almost 20% of the case inventory it inherited on March 4 and continues to work towards reducing that inventory while assuring that every case receives the attention it deserves from the board members, Spencer said.
